Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to promote the petitioner as Chief Civil Surgeon with all attendant benefits by considering his application,dated 05.02.2019 within a stipulated period as fixed by this Court.

ORDER

The Writ Petition is filed seeking a direction to the respondents to promote the petitioner as Chief Civil Surgeon with all attendant benefits by considering his application,dated 05.02.2019 within a stipulated period as fixed by this Court.

2. Heard the learned Counsel appearing for the petitioner and the learned Special Government Pleader appearing for the respondents and perused the materials available on record.

3. The case of the petitioner is that he was appointed on 11.12.1995 as Sports Doctor and thereafter, after subsequent transfers, now, he is working as Medical Officer at Primary Health Centre, Mattaparai Village, Dindigul District. The grievance of the petitioner is that he is working from 1995 onwards without having any single promotion. Hence, the petitioner made several representations and finally on 05.02.2019 to the respondents seeking promotion. However, the same are pending without any consideration. Therefore, the petitioner has approached this Court by filing this Writ Petition.

4. The learned Special Government Pleader appearing for the respondents submitted that the representation of the petitioner would be considered by the respondents on merits, within a time frame as fixed by this Court.

5. In view of the above, without going into the merits of the case, the respondents are directed to consider the representation/application of the petitioner dated 05.02.2019 seeking promotion and pass appropriate orders on merits and in accordance with law, after affording an opportunity of hearing to the petitioner, within a period of six weeks from the date of receipt of a copy of this order.

6. The Writ Petition stands disposed of with the above direction. No costs.
