ORDER : The Court Made the following order :- The petitioner is arrayed as sole accused, who was arrested and remanded to judicial custody on 01.07.2016, for the alleged offences punishable under Section 324 IPC, and Section 3(1) TNPPDL Act, in Crime No.583 of 2016, on the file of the respondent police and hence, seeks bail.
2.The case of the prosecution is that on 01.07.2016, while the defacto complainant/RTO was on duty and checking up the vehicles, to find out the illegal movement of the vehicles, the petitioner, who is the cleaner of a mini bus belonged to a private party, attacked the defacto complainant/RTO and his driver and damaged the jeep of the defacto complainant, opened the diesel tank and tried to set fire and also deflated the tire. Due to that the defacto complainant and his driver sustained injuries. On complaint, a case has been registered for the above said offences.
3.The case of the petitioner is that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution. The petitioner is an Auto driver and there is no injury or damage caused by the petitioner and he is no way connected with the alleged occurrence.
4.The learned Government Advocate (Crl. side) submitted that the defacto complainant is a Government official, at the time of doing their duty, the petitioner attacked the Government officials and damaged the jeep of the defacto complainant/RTO and prevented https://hcservices.ecourts.gov.in/hcservices/
the Government officials from doing their duty. Investigation is pending. If the petitioner is enlarged on bail, he will tamper the witnesses and hamper the investigation and prayed for dismissal of the petition.
