Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a Writ of Certiorarified Mandamus to call for the records on the files of the 2nd respondent pertaining to its order bearing No.Nil dated Nil and to quash the same with regard to time restrictions and consequently direct the respondents to grant permission to conduct the temple festival and cultural programme from 25/04/2018 to 05/05/2018 as per the programme schedule at Arulmigu Sree Vetti Murichan Isakkiyamman Temple situated in Perumal puram, Kottaram post, Kanyakumari District.

JUDGMENT

[Judgment of the Court was delivered by C.T.SELVAM, J.] The Writ Appeal is directed against the order dated 16.04.2018 made in W.P(MD)No.7562 of 2018.

2. The appellant herein filed W.P(MD)No.7562 of 2018 challenging the order of the second respondent herein, rejecting the request of the appellant to grant permission to conduct the temple festival and cultural programme at Arulmigu Sree Vetti Murichan Isakkiyamman Temple, Perumalpuram, Kottaram Post, Kanyakumari District, till 12.00 midnight.

3. On consideration of the rival submissions, the learned Single Judge, while modifying the order passed by the second respondent and allowing the Writ Petition, has extended the time upto 10.30 p.m, to conduct cultural programme or events, keeping in mind the earlier orders passed by this Court. The uniformity adopted by the learned Single Judge, in our considered view, cannot be found fault with.

4. We do not find any merit in the Writ Appeal. Accordingly, the Writ Appeal is dismissed. No costs. Consequently, connected Miscellaneous Petition is closed.
