Respondents PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents to forthwith to appoint the petitioner as Noon Meal Organizer under the control of 5th respondent under compassionate ground or in any one of suitable post according to his educational qualification. ORDER

Seeking a direction to the respondents to give compassionate appointment, the petitioner is before this Court.

2.Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader for the respondents. 3.The case of the petitioner is that her mother, who was working as a Noon Meal Organizer at Palamalai Village, Kodaikanal Taluk, passed away while in service. Seeking appointment on compassionate ground, the petitioner made a representation dated 18.05.2015. While so, the second respondent sought some clarifications and requested the fourth respondent to rectify certain mistakes. In the meantime, the fifth respondent has sent the petitioner's proposal to the fourth respondent, after rectifying all the clarifications by communication dated 22.07.2016. However, till date there is no response from the respondents. Hence, this writ petition has been filed. 4.The learned Additional Government Pleader, on instructions, submitted that the representation of the petitioner would be considered on merits.

5.In view of the above submission, this Court, without going into the merits of the case, directs the respondents 1 to 4 to consider the representation of the petitioner dated 18.05.2015, seeking compassionate appointment, in the light of the communication sent by the fifth respondent dated 22.07.2016 and pass appropriate orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order, after affording an opportunity of hearing to the petitioner.

6.The writ petition is disposed of with the above direction. No costs.
