ORDER : The Court Made the following order :- The petitioner is arrayed as accused No.3, who was arrested and remanded to judicial custody on 19.07.2016, for the alleged offences punishable under Sections 366(A), 177, 212, 216 and 217 IPC, in Crime No.153 of 2016, on the file of the respondent police and hence, seeks bail.
2.The case of the prosecution is that the petitioner along with other accused persons kidnapped the daughter of the defacto complainant, who is a minor, aged 15 years. On complaint, a case has been registered for the above said offences.
3.The case of the petitioner is that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution. The petitioner is the owner of the house and he is no way connected with the alleged occurrence.
4.The learned Government Advocate (Crl.side) submitted that the petitioner along with other accused kidnapped the minor girl of the defacto complainant and the victim girl is not yet secured and in this regard, a Habeas Corpus Petition filed by the defacto complainant is pending before this Court. Investigation is pending. If the petitioner is enlarged on bail, he will tamper the witnesses and hamper the investigation and prayed for dismissal of the petition.

5.Considering the fact that the victim girl is not yet secured, this court is not inclined to grant bail to the petitioner. Hence, this petition is dismissed.
