PRAYER:- Petition filed under Section 11 of the Contempt of Courts Act, 1971 to punish the Contemnors for their act of willful violation and disobedience of the orders of this Honourable Court dated 24.10.2019 passed by this Honourable Court in Cont.P(MD)No.1544 of 2019 in WP(MD)No. 24151 of 2018.

ORDER
(Order of the Court was made by S.M.SUBRAMANIAM, J.) The Contempt Petition has been instituted to punish the respondents for their willful disobedience of the orders of this Court dated 19.07.2019 in W.P.(MD) No.24151 of 2018. The order reads as under: "4.In view of the fact that the petitioner is only asking for his representation, dated 16.10.2018, to be considered and for consequential action, if it is found that the construction made by the fifth respondent is illegal, without expressing any opinion on the merits of the dispute, we propose to dispose of the writ petition, by directing the fourth respondent, to consider the representation, dated 16.10.2018, of the petitioner and
pass orders thereon, within a period of four weeks from the date of receipt of a copy of this order, after providing reasonable opportunity of hearing both to the petitioner and the fifth respondent. The said decision shall be made by a speaking order on merits and in accordance with law."

This Court has not disposed of the writ petition on merits but directed the fourth respondent / Block Development Officer therein to consider the representation dated 16.10.2018 of the petitioner and pass orders thereon within a period of four weeks from the date of receipt of a copy of that order. Since the said order has not been complied with, a Contempt Petition No.1544 of 2019 was issued. The said contempt petition was also disposed of by this Court on 24.10.2019 providing one more opportunity to the Block Development Officer to comply with the directions. Consequently, the Block Development Officer considered the representation submitted by the petitioner and passed orders in proceedings dated 15.09.2023. The petitioner not satisfied with the said order, once again filed the present Contempt Petition in Cont.P.(MD) No.857 of 2020. The learned counsel for the petitioner would submit that the present contempt petition has been filed against the order passed in the contempt petition. Such proceedings are not entertainable in
view of the fact that the original order passed in the writ petition has already been complied with by the Block Development Officer by considering the representation and passing orders in proceedings dated 15.09.2023. If at all any grievance exists, the petitioner has to adjudicate it in the manner known to law. Therefore, the respondents are not committed any willful disobedience of the orders of this Court and hence, the contempt petition stands dismissed.
