ORDER

This petition is filed seeking to quash the First Information Report in FIR in Crime No.84 of 2025 dated 20.02.2025 pending on the file of the first respondent, which was registered for the offences under Section 194(2) of BNS, 2023.

2. The gist of the allegations is that on 18.02.2025, at about 11.00 p.m., in front of Kuttapa Karuppati Coffee Shop, in Tenkasi District, the persons belonging to two different groups involved in affray and thereby, causing disturbance to the public tranquility. Hence, the present case.

3. The learned counsel for the petitioner would submit that the first respondent police registered a case against the petitioner for the offence under Section 194(2) of the BNS, 2023, for which the prescribed punishment is only a period of one month. However, even after a period of more than ten months, the final report has not yet been filed. 2/5

4.Recording the submission made by the learned counsel appearing for the petitioner, this criminal original petition is allowed. The impugned FIR in Crime No.84 of 2025, dated 20.02.2025, is hereby quashed. Consequently, the connected Criminal Miscellaneous Petition is closed.
