RESPONDENT/RESPONDENT Criminal Miscellaneous Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to modify the condition No. 7(b)(i) imposed upon the petitioners in Crl O.P (MD) No. 1169/2024 order dt. 29.01.2024.

Order : This Criminal Miscellaneous Petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of MR.M.MAHARAJA, Advocate for the petitioner and of MR.P.KOTTAICHAMY, Government Advocate (Criminal Side)on behalf of the Respondent and of MR.B.RAMANATHAN, Advocate for the Intervenor, the court made the following order:- 1/4

This Petition has been filed to modify the condition No.7(b)(i) imposed upon the petitioners in Crl.O.P.(MD)No.1169 of 2024, dated 29.01.2024. 2.On an earlier occasion, the petitioners agreed to deposit Rs.15,00,000/- to the defacto complainant's child namely, Karthigai Selvi, on their own volition. Regarded the same, this Court granted anticipatory bail to the petitioners. Later, the petitioners filed the present petition before this Court for modification.

3.The learned counsel for the petitioners would submit that the petitioners are ready to deposit the said amount to the defacto complainant's child, namely, Karthigai Selvi and the defacto complainant may be permitted to withdraw the said amount after her daughter attains the age of 21. Hence, he prayed for modifying the said condition.

4.In view of the above, the defact complainant is directed to provide the bank details and Aadhar card to the petitioners. Further, the condition No.7(b)(i) imposed upon the petitioners in Crl.O.P.(MD)No.1169 of 2024, dated 29.01.2024 is modified to the effect that the petitioners shall deposit Rs.10,00,000/- in any one of Nationalized Banks in Fixed Deposit in the name of the defacto complainant's child namely, Karthigai Selvi within a period of two weeks as the first installment and thereafter, the petitioners shall deposit Rs.5,00,000/- in the same Nationalized Bank in Fixed 2/4

Deposit in the name of the defacto complainant's child namely, Karthigai Selvi, within a period of two weeks as the second installment. However, the defacto complainant is not entitled to withdraw the said amount till her daughter attains the age of 21.
