For Respondent : Mr.K.Suyambulinga Bharathi, Government Advocate (Crl.Side) PETITION FOR RELAXATION Under Sec.439(1)b of Cr.P.C PRAYER :- To relax the condition imposed as per the order dated 11/12/2019 regarding the monthly payment of maintenance amount of Rs.3000/- to the de-facto complainant in Crl.O.P.(MD) No.18551 of 2019 and thus render justice.

ORDER : The Court Made the following order :- The petition has been filed to relax the condition imposed on the petitioner in CRL.OP(MD)No.18551 of 2019.

2. The learned counsel for the petitioner would submit that this Court has no power to order for maintenance while dealing with anticipatory bail. Hence, the learned Counsel for the petitioner prays for relaxation of condition imposed by this Court while dealing with anticipatory bail.

CRL MP(MD). No.3299 of 2020 in 3.Considering the facts and circumstances of the case, this Court, while exercising the discretionary power to grant anticipatory bail, has rightly imposed the condition that the petitioner should pay a sum of Rs.3,000/- as maintenance in favour of his wife. Hence, this Court has no reason to entertain this petition.

4.Accordingly, this petition is dismissed.
