O R D E R

This criminal original petition has been filed seeking a direction to transfer the investigation in Crime No.184/2022 on the file of the 3rd respondent to any other competent officer.

2. The learned Counsel appearing for the petitioner submits that the case was registered on 07.12.2022 and for the past two years, the respondent police has not conducted any investigation.

3. The learned Government Advocate (Crl. Side) submits that the complaint of the petitioner was duly enquired and the same was closed as mistake of fact on 21.02.2024. The respondent has also produced the RCS notice to the petitioner. Further, he submits that the case is posted on 15.07.2024 before the learned Special Court for PCR Cases concerned.

4. This Court considered the rival submissions made.

5. Since it is reported that the RCS notice has already been served to the petitioner and the final report has also been filed before the Court concerned, this criminal original petition is closed with a liberty to the petitioner to file a protest petition and workout his remedy before the Court concerned.
