Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused apprehend arrest at the hands of the respondent police for an alleged offence punishable under Sections 302 and 109 of IPC, in Crime No.1468 of 2016, seek anticipatory bail.

2. The case of the prosecution is that the accused persons attacked the deceased with Aruval on head and caused injury and due to the injury, the deceased died. On complaint, case has been registered for the above said offences.

3. The learned counsel for the petitioners submitted that the petitioners are innocent and they have not committed any offence as alleged by the prosecution and their names have been falsely implicated in this case. He further submitted that A1 and A3 are the sons of the petitioners, A2 is son in law of the petitioners and A5 is the sister of the second petitioner and the deceased also one of the sister of the second petitioner. case and prays for granting anticipatory bail in favour of the petitioners.

4. The learned Government Advocate (Crl. Side) submitted that A1, A2 and A5 are already arrested and remanded to judicial custody and the investigation of the case is in preliminary stage.

5. Considering the serious nature of allegations against the petitioners and that the occurrence took place only on 16.07.2016 and the investigation is in preliminary stage, this Court is not inclined to grant anticipatory bail to the petitioners.
