Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, directing the respondents herein to remove the encroachment in the cart track situated in S.No.715 (Malaipatti Village) situated between Sangalpatti Village to Malaipatti Village based on the representation of the petitioner dated 24.08.2020 within a time frame as stipulated by this Honourable High Court. ************ [Order of the Court was made by T.S.SIVAGNANAM, J.] We have heard Mr.A.Sarvagan Prabhu, learned counsel appearing for the petitioner and Mr.A.K.Manickam, learned Standing Counsel for Government, appearing for the respondents.
2.This Writ Petition has been filed seeking for a direction upon the respondents herein to remove the encroachment in the cart track situated in S.No.715 (Malaipatti Village) between Sangalpatti https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P.(MD) No.7021 of 2021 Village to Malaipatti Village based on the representation of the petitioner dated 24.08.2020.
3.Though in the Writ Petition, the petitioner alleges encroachment in S.No.715, Malaipatti Village, Vedasendur Taluk, according to the instructions given to the learned Government Counsel, the encroachment is in S.No.719.
4.Therefore, we direct the third respondent to take appropriate legal action and ensure that there is no encroachment either in S.No.719 or any other adjoining survey numbers. Before removal of encroachment, notice should be served on the encroacher and after hearing his objection only action should be taken. The said exercise shall be completed within eight weeks from the date of receipt of a copy of this order.
5.The Writ Petition stands disposed of with the above directions. No costs.
