ORDER

Invoking the provisions of Article 227 of the Constitution of India, the petitioner has approached this Court with this Civil Revision Petition, seeking a direction to the learned District Munsif cum Rent Controller, Trichy to dispose of R.C.O.P.No.160 of 2010, as expeditiously as possible preferably within a time, which may be fixed by this Court.

2. When the matter was taken up for hearing on 06.11.2015, it was represented by Mr.M.Siddharthan, learned counsel appearing for the petitioner, that a petition in Tr.O.P.No.2 of 2015 in R.C.O.P.No.160 of 2010 was pending on the file of the learned Principal Subordinate Judge, Trichy and the same was dismissed as not pressed. But no reference is available before this Court in connection with the order of dismissal of that Tr.O.P.No.2 of 2015. However, he had assured that he would file a memorandum to that effect.

3. Today, he has filed a memoramdum, wherein he has stated that the said Tr.O.P.No.2 of 2015 was dismissed as not pressed by the learned Principal Subordinate Judge, Trichy. The said memorandum is taken on record.

4. It is revealed from the records that the revision petitioner herein, has filed a petition in R.C.O.P.No.160 of 2010, and the same has been unnecessarily and periodically adjourned without assigning any valid reason and therefore, the petitioner has approached this Court by way of this Civil Revision Petition.

5. Having been taken into consideration of the related facts and circumstances, this Court is of view that in the interest of Justice it may be expedient to issue a direction to the trial Court, as sought for by the petitioner.

6. Accordingly, this Civil Revision Petition is allowed. The learned District Munsif cum Rent Controller, Trichy is hereby directed to dispose of R.C.O.P.No.160 of 2010, within a period of one month from the date of receipt of a copy of this order, without loss of further time. However, there shall be no order as to costs.
