ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 7(3) of the Lotteries (Regulation)Act, 1998,in Crime No. 857 of 2017 on the file of the respondent police, seeks anticipatory bail. 2.Heard the learned counsel on either side.

3.The case of the prosecution is that the on 20.12.2017, during inspection, the respondent police found that A1 to A3 sold the Lotteries against the Law and Regulations. Further the respondent police have arrested the accused no.2 and recovered 10 numbers of lottery sheets and a sum of Rs.150/- from him and remanded to Judicial custody. Based on the complaint, case has been registered for the above said offences.

4.It is submitted by the learned counsel for the petitioner that no such occurrence was happened as alleged by the prosecution. He further submitted that the petitioner is an innocent person and he has not committed any offence and prays for anticipatory bail. 5.The learned Government Advocate (Crl.side) submitted that there are totally three accused in this case and the petitioner herein is A1. He further submitted that the petitioner has one previous case in the similar nature of offence. Hence he opposed for granting anticipatory bail.

6.Considering the facts and circumstances of the case and also considering the submission made by the learned Government Advocate (Crl.side) that the petitioner is having one previous case in the similar nature of offence, I am not inclined to grant anticipatory bail to the petitioner.

Accordingly, this Criminal Original Petition is dismissed.
