PRAYER: Transfer Civil Miscellaneous Petition is filed under Section 24 of the Code of Civil Procedure to withdraw the proceedings pending in H.M.O.P. 75 of 2018 from the file of SubCourt, Kulithalai and transfer the same to Family Court, Karur. For Petitioner : Mr.K.Suresh For Respondent : Ms.P.Malini

O R D E R

The present Transfer Civil Miscellaneous Petition is filed for transfer of H.M.O.P.No.75 of 2018, now pending on the file of the Sub-Court, Kulithalai to the Family Court, Karur. 2.The petitioner is the wife of the respondent. She has laid D.V.P.No.15 of 2018 before the Judicial Magistrate No.I, Karur. The said case has now been transferred to Additional Mahila Court, Karur in D.V.P.No.84/2020. The respondent, on his part, has filed H.M.O.P.No.75 of 2018 before the Sub Court, Kulithalai for restitution of his conjugal rights, which is now sought to be transferred to the Family Court, Karur.

3.Heard, Mr.K.Suresh, learned counsel for the petitioner and Ms.P.Malini, learned counsel for the respondent. 4.The learned counsel for the respondent would submit that she has no major objection with regard to the relief sought for by the petitioner in this regard.

5.In view of the submissions made by the learned counsel for the respondent, the Transfer Civil Miscellaneous Petition is allowed. Accordingly, H.M.O.P.No.75 of 2018, now pending on the file of the Sub-Court, Kulithalai is directed to be withdrawn from https://hcservices.ecourts.gov.in/hcservices/ 1/2

Tr.C.M.P.(MD) No.170 of 2020 the said Court and transferred to the Family Court, Karur for disposal as per law. No costs. Consequently, connected miscellaneous petition is closed.
