ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence under Section 363 IPC, in Crime No.73 of 2023, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant has two daughters and one son and her younger daughter was found missing on 27.11.2023. The defacto complainant searched her daughter in nearby places and she was not able to find her daughter. Hence, the complaint.

3. The learned counsel appearing for the petitioners would submit that the petitioner did not commit any offence as alleged by the prosecution and he has been falsely implicated in this case. He would further submit that it is a love affair between the petitioner and the victim girl and with her consent, the petitioner has taken the victim girl.

4. The learned Government Advocate (Crl.side) appearing for the respondent Police produced the statement recorded from the victim girl under Section 164 Cr.P.C and submitted that the victim girl was forcibly taken by the petitioner and she was made to sexual harassment by the petitioner. Hence, he prays for dismissal of this petition.

5. Considering the facts and circumstances of the case and the seriousness allegation levelled against the petitioner that the minor victim girl was forcibly taken 2/3

by the petitioner and she was made to sexual harassment by the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
