ORDER
Heard the learned counsel appearing for the writ petitioner and the learned Additional Solicitor General appearing for the respondents.
2.The petitioner seeks issuance of passport. But then after submitting his application, he did not turn up for the interview and that was the only reason for closing his file. I am in agreement with the submission of learned Additional Solicitor General that the first respondent cannot be blamed for closing file of the petitioner and this is only on account of the non cooperation of the writ petitioner. The learned Additional Solicitor General submitted that the petitioner can submit a fresh application to the first respondent which would be definitely considered on merits and as expeditiously as possible. It is made clear that if any criminal case is pending against the petitioner at the FIR stage, it will not be a bar or impediment for issuance of passport. https://hcservices.ecourts.gov.in/hcservices/
3.Recording the submission of the learned Additional Solicitor General and clarifying the legal position, this Writ Petition stands disposed of. No costs.
