Prayer:

To exempt court fee amount of Rs.79,500/- (Court fee payable Rs.79,873/- and court fee paid Rs.373/-) in preferring appeal against the Fair and Decreetal dated 07.01.2020 passed in MCOP.No.81 of 2014 on the file of the Motor Accidents Claims Tribunal, II Additional District Court, Thoothukudi and enhance the compensation and render justice.

ORDER

(Order of the Court was made by the Hon'ble N.Anand Venkatesh J.) This petition has been filed seeking exemption from payment of the court fee of Rs.79,500/- (Court fee payable Rs.79,873/- and court fee paid Rs.373/-) in preferring appeal against the Fair and Decreetal dated 07.01.2020 passed in MCOP.No.81 of 2014 on the file of the Motor Accidents Claims Tribunal, II Additional District Court, Thoothukudi and to enhance the compensation.

2. It is seen from the award that the compensation amount of Rs.6,50,000/- was fixed which is payable with 7.5% interest. The learned counsel appearing for the petitioners on instructions submitted that this award amount has already been deposited by the third respondent / Insurance Company.

4. In view of the above, the Tribunal shall permit the petitioners to withdraw the compensation amount along with the interest in the proportion fixed by the Tribunal. On such withdrawal, the Court fee shall be paid by the petitioners.

5. This Petition is disposed of in the above terms.

6. Registry is directed to post this case under the caption "For Reporting Compliance" on 18.06.2026.
