PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Certiorarified Mandamus, calling for the records of the impugned order passed by the respondent in his proceedings in Na.Ka.No.RV2/715/2020, dated 17.08.2020 and consequently direct the respondent to reinstate the petitioner in the post of Salesman in the TASMAC Shop No.10401, Mettukadai, Manapparai Taluk, Trichy District. For Petitioner :No appearance For Respondent :Mr.B.Jameel Arasu

This writ petition is filed challenging the order of suspension, dated 17.08.2020.

2.The case of the petitioner is that he was working as a Salesman under the respondent from 2004 onwards. He was placed under suspension 17.08.2020, pursuant to the criminal case registered as against him in Crime No.1486 of 2020. Challenging the same, the petitioner is before this Court with the present writ petition. 3.The learned counsel appearing for the respondent submits that the petitioner was placed under suspension for the serious allegation of misappropriation of fund in the respondent office. A criminal case in Crime No.1486 of 2020 has also been registered as against the petitioner on 15.08.2020, pursuant to which, he was placed under suspension on 17.08.2020. Enquiry was also conducted and the charges levelled as against him were proved and the petitioner was also dismissed from service, by order dated 15.12.2021.

4.In view of the submission made by the learned counsel appearing for the respondent that the petitioner has already been dismissed from service on 15.12.2021, nothing survives for further adjudication in this writ petition.

W.P(MD) No.6992 of 2021 5.Accordingly, this writ petition is closed. The respondent shall serve the copy of the dismissal order to the petitioner, within a period of two weeks from the date of receipt of a copy of this order. It is always open to the petitioner, to challenge the order of dismissal, if he is so advised. No costs. Consequently, connected Miscellaneous Petitions are closed.
