BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT ( Criminal Jurisdiction ) Thursday, the Twenty Eighth day of December Two Thousand Seventeen PRESENT The Hon`ble Mr Justice S.VAIDYANATHAN CRL OP(MD) No.18046 of 2017 R.PRABAKARAN ... PETITIONER / ACCUSED RANK NOT KNOWN Vs THE STATE REP.BY, THE INSPECTOR OF POLICE SOMARASAMPETTAI POLICE STATION, TRICHY DISTRICT (CR.NO.385/2017) ... RESPONDENT / COMPLAINANT For Petitioner : M/S.P.T.RAMESH RAJA Advocate For Respondent : MR.K.ANBARASAN Govt. Advocate ( Crl. Side) PETITION FOR BAIL Under Sec. 439 Cr.P.C.

ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 02.11.2017 for the offences punishable under Sections 420, 468, 471 and 473 IPC in Crime No.385 of 2017 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner in collusion with other accused is said to have created fake documents by affixing seal in the Government document and submitted the same before the Somarasampettai Co-operative Society for loan, which resulted in registration of the present case.

3. The learned counsel for the petitioner has submitted that the petitioner, who has been falsely implicated in this case, is in jail since 02.11.2017 and is entitled to statutory bail in another 10 days' time. Therefore, he prays for bail and he is ready to abide by any conditions being imposed by this Court.

4. The learned Government Advocate (Crl.Side) has strongly objected to the grant of bail, contending that the investigation of the case is not over and if the petitioner/accused is let out on bail, there is every possibility of the accused tampering the witnesses/evidences and hampering the investigation. https://hcservices.ecourts.gov.in/hcservices/

5. Taking into consideration the serious nature of the allegations levelled against this petitioner and the fact that a

long incarceration is not a valid ground for the grant of bail, this Court is not inclined to grant the relief as prayed for by the petitioner.

6. In the result, this Criminal Original Petition stands dismissed accordingly.
