For Respondent : Mr.M.Ganesan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime no.88 of 2021 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioners, who are arrayed as Accused Nos.1 to 4, apprehending arrest at the hands of the respondent police for the alleged offences punishable under Sections 294(b), 307, 324, 341 and 506(ii) of IPC, in Crime No.88 of 2021 on the file of the respondent police, seek anticipatory bail.

2.The case of the prosecution is that on 28.02.2021, at about 06.00 p.m when the defacto complainant was on his way to Thirupajali Market, he was intercepted by the petitioners and others. At that time, the petitioners along with others said to have abused the defacto complainant by using filthy language and also assaulted him with hands. Hence, the present complaint.

3.The learned counsel appearing for the petitioners submitted that the petitioners have been falsely implicated in this case that https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.4887 of 2021 a case in counter has been registered in Crime No.89 of 2021 against the defacto complainant. He further submitted that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. Hence, he prayed for grant of anticipatory bail to the petitioners.

4.The learned Government Advocate (Crl. Side) appearing for the respondent Police strongly opposed this petition on the ground that there are several incidents happened between two groups. He further submitted that there are seven previous cases pending against each other.

5.This is the second application and there is no change of circumstances to entertain this application. Considering the facts and circumstances of the case and also considering the bad antecedents of the petitioners and the fact that the investigation is at crucial stage, this Court is not inclined to grant anticipatory bail to the petitioners.

6.Accordingly, this Criminal Original Petition stands dismissed.
