PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorari to call for the records relating to the order passed by the 2nd respondent in his proceedings MD/TNY/7130/RECY/3rd party 8F/2026 dated 28.01.2026 and the consequential order passed by the 1st respondent in his proceedings MD/TNY/7130/RECY/3rd party 8F/2026 dated 06.02.2026 and quash the same as illegal.

The petitioner assails the order dated 28.01.2026 passed by the second respondent and the consequential order dated 06.02.2026 passed by the first respondent. By the said orders, the petitioner's bank account has been frozen on the ground that contributions towards Employees' Provident Fund in respect of another concern, namely, "M/s. Seyed Beedi Company", have not been paid.
2. Heard Ms. H. Jasima Yasmin, learned counsel for the petitioner, and Mr. T. Ashwin Rajasimman, learned counsel appearing for the 2/5
respondents 1 and 2.
3. The petitioner contends that it is not a sister concern of "M/s. Seyed Beedi Company" and that it had only purchased beedis from the said establishment.
4. However, the learned counsel for the respondents 1 and 2 placed on record the proceedings dated 27.02.2026 issued by the Regional Provident Fund Commissioner-II (Legal), wherein it is stated that the amount due towards Employees' Provident Fund contribution has been paid by "M/s. Seyed Beedi Company".
5. In view of the fact that the dues have already been settled, the impugned orders passed by the respondents are liable to be set aside. Accordingly, this writ petition is allowed, and the impugned order passed by the second respondent in proceedings No. MD/TNY/7130/RECY/3rd party 8F/2026 dated 28.01.2026 and the consequential order passed by the first respondent in proceedings of the same number dated 06.02.2026 are hereby quashed.

6. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
