RESPONDENT/ RESPONDENT Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court may be pleased to condone the delay of 872 days in representing this civil miscellaneous second appeal in C.M.S.A.Sr.No.33789 of 2015 and thus render justice.

PRAYER IN CMSA(MD)SR.No.33789 of 2015:

To set aside the fair and decreetal order passed in H.M.C.M.A.No.2 of 2014 on the file of the 2nd Additional District Court, Thoothukudi dated 06.04.2015 confirming the fair and decreetal order passed in H.M.O.P.No.60 of 2008 on the file of the Sub Court, Kovilpatti dated 10.03.2014.

ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.T.SELVAN, Advocate for the petitioner, the court made the following order:- This petition has been filed to condone the delay of 872 days in representing the above Appeal.

2. Considering the reasons stated in the affidavit filed in support of this petition, this petition is allowed and the delay is condoned on payment of cost of Rs.1,000/- (Rupees One Thousand Only) to the Tamil Nadu Mediation and Conciliation Centre attached to this Court, today itself i.e on 04.06.2018. On production of receipt, Registry is directed to number the appeal and post the same for admission on 05.06.2018.
