PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- for Anticipatory bail in Crime No.39 of 2020 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under Section 379 of I.P.C., and 21(1) of MMDR Act, in Crime No.39 of 2020, on the file of the respondent police, seeks anticipatory bail.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal Side) appearing for the respondent.

3. The learned counsel for the petitioner would submit that the petitioner is innocent and he has no way connected with the alleged offences.

4. The learned Government Advocate (criminal side) appearing for the State would submit that the petitioner is the driver of the vehicle and he has illegally transported one unit of odai sand without any permit.

5. Taking note of the over exploitation of the natural resource of river sand illegally, I am not inclined to grant anticipatory bail.
