Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondent Nos.1 to 4 to take necessary action based on the petitioner's representation dated 18.02.2026 within the stipulated time fixed by this Court. ORDER

This Writ Petition has been filed seeking a direction to respondent Nos.1 to 4 to take necessary action based on the petitioner's representation dated 18.02.2026 within the time stipulated by this Court.

2. Mr.Narayanan, S/o. Periyathambi, Door No.1/73, Kalathur Village, Mithravayal Post, Devakottai Taluk, Sivagangai District, is suo motu impleaded as the fifth respondent in this Writ Petition.

3. Mr.K.Balasubramani, learned Special Government Pleader, takes notice for respondent Nos.1 to 3, Mr.A.Oliraja, learned Government Advocate, takes notice for the fourth respondent and 2/6

Mr.S.Vashik Ali, learned counsel, takes notice for the newly impleaded fifth respondent. By consent of all parties, this Writ Petition is taken up for final disposal at the stage of admission itself.

According to the petitioner, the land in S.No.244/10 situated at Kalathur Village, Devakottai Taluk, Sivagangai District, has been classified as a Government common pathway by the proceedings of the second respondent dated 07.10.2025. However, the Panchayat President has not completed the construction of the road, and the existing road in the village is in a very dilapidated condition. As a result, the villagers are facing considerable difficulties due to the incomplete construction of the road. Thereafter, the petitioner filed a Writ Petition before this Court in W.P.(MD).No.6525 of 2025, which was disposed of on 12.03.2025. Pursuant to the same, the second respondent conducted an enquiry and declared the said survey number as a common pathway. In this regard, the petitioner submitted a representation dated 18.02.2026 to respondent Nos.1 to 4 requesting them to lay a thar road in the said survey number. However, no action has been taken by the respondents till date. Hence, the present Writ Petition has been filed.

5. The learned Special Government Pleader appearing for the official respondents submitted that the petitioner's representation dated 18.02.2026 will be considered in accordance with law.

6. The learned counsel appearing for the newly impleaded fifth respondent submitted that notice must be issued to the fifth respondent, since he has raised an objection with regard to the formation of the layout.

7. This Court, without expressing any opinion on the merits of the matter, directs the fourth respondent to consider the petitioner's representation dated 18.02.2026, after issuing due notice to the fifth respondent, and take appropriate action on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

8. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. costs.
