ORDER

This writ petition has been filed for a direction to the respondents to allow the petitioner to work as Packer in the second respondent Society upto the age of 60 years with all benefits.

2. The learned counsel appearing for the petitioner would submit that the petitioner was appointed as a Packer on daily wage basis in the second respondent society on 29.12.2010 and he served in the society for nearly 9 years and 2 months without any complaint. Since the petitioner is a last grade servant, his service has to be engaged upto 60 years. However, the second respondent informed that the petitioner attained the age of superannuation on 31.03.2020 ie., on reaching the age of 58 years. Aggrieved by the same, the petitioner has filed this writ petition with the aforesaid prayer.

3. When the matter was taken up for hearing today, the learned Government Advocate appearing for the respondents, would submit that during the pendency of this writ petition, the petitioner crossed the age of 2/4

60 years and hence, nothing survives for adjudication in this writ petition.

4. In view of the same, this writ petition is dismissed as infructuous. No Costs. Consequently, connected miscellaneous petition is closed.
