ORDER
The learned Counsel for the Petitioner submits that the Petitioner earlier moved W.P.(MD) No.2220 of 2024 seeking permission to conduct the temple festival of Sri Sangaiyasamy, Sri Karuppasamy Temple situated at Atchankulam Village, Thiruppuvanam Taluk, Sivagangai District. The said petition was disposed of by this Court vide order dated 05.02.2024 directing the Respondents to consider the representation of the Petitioner favorably in the light of the circular of the Director General of Police, Head of State Police Force, Tamil Nadu, Chennai-4, issued in Rc.007301/Genl.I(1)/2019, dated 09.04.2019. 2.It is the further contention of the learned Counsel for the Petitioner that when the Petitioner intended to conduct the programme, Katchaikatti Samiyattam Aaduthal, which is a traditional form of ritual performed by the Petitioner herein, there was objection from the rival group. Therefore, the second Respondent had issued summons and referred the matter to the Tahsildar, Thiruppuvanam. In the peace committee meeting, both the parties had not arrived at compromise. 2/5
Therefore, the ritual, Katchaikatti Samiyattam Aaduthal, was not performed. The Tahsildar had permitted only to worship in the temple. 3.The learned Government Advocate (Crl.side), on instructions of the second Respondent, would submit that since there was objection from the rival parties, the second Respondent referred the matter to the Tahsildar, Thiruppuvanam. In the peace committee meeting both the parties had not arrived at compromise. Therefore, the Tahsildar had permitted only worship and festival in the temple and not to permit to conduct the ritual, Katchaikatti Samiyattam Aaduthal.
4.Today (08.03.2024), when the matter came up for hearing, Mr.A.Karthigaivel, learned Counsel for the Petitioner has no objection for the rival group to perform Katchaikatti Samiyattam Aaduthal. 5.In the light of the above, the second Respondent/the Inspector of Police, Palaiyanoor Police Station is within his/her discretion to permit the Petitioner and the rival group to perform Katchaikatti Samiyattam Aaduthal. Both the parties are 3/5
directed to give an undertaking to the second Respondent in this regard. The earlier order is to be continued.
