Prayer : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the first respondent not to harass or ill treat the petitioner in connection with the alleged compliant given by the third respondent.

ORDER

This petition is filed seeking direction to the first respondent not to harass the petitioner on the basis of the complaint given by the third respondent herein. 2.On 04.08.2021, when the matter was taken up for hearing, the learned Additional Public Prosecutor submitted that based upon the complaint given by the third respondent, enquiry was undertaken in CSR No.2 of 2021 and during the enquiry, it was found that it is civil dispute between the parties and on that ground, it was closed on 28.06.2021. It was further submitted that though the third respondent was summoned, he did not appear for enquiry and only the petitioner appeared before the enquiry officer. Hence, the copy of the closure report was ordered to be circulated before this Court today.

Crl.O.P.(MD)No.4711 of 2021 3.Today (05.10.2021), copy of the closure report is circulated. Reading of the same shows that the third respondent did not co-operate with the enquiry and based upon the documents that have been produced by the petitioner, it is seen that it is civil dispute between the parties. On that ground, it was closed on 25.06.2021.

4.Since enquiry has been closed observing that there is civil dispute, nothing survives for further consideration or direction in this petition. Accordingly, this Criminal Original Petition is disposed of.
