ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Section 174 of the Code of Criminal Procedure @ Section 306 of the Indian Penal Code, in Crime No.61 of 2017, on the file of the respondent police, seeks anticipatory bail.

2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondent/State.

3.The learned counsel appearing for the petitioner would submit that one Radhakrishnan committed suicide in the year 2006. Earlier, the deceased Radhakrishnan preferred a complaint against this petitioner, which was registered in Crime No.7 of 2015. The petitioner preferred Crl.OP(MD).No.10513 of 2015 and he was granted Anticipatory Bail, on 23.06.2015. For the occurrence, which took place in the year 2006, once again, for the same set of fact, on the complaint of the deceased Radhakrishnan's wife the present First Information Report has been registered in Crime No.61 of 2017, on the file of the respondent police.

4. Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Musiri, and on his executing a bond for a sum of Rs.10,000/- each (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the first petitioner shall appear before the respondent police once in a week, viz., every Monday at 10.30 AM, for a period of eight weeks. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

5.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
