DECREE : This Appeal coming for hearing on this day, upon perusing the grounds of Appeal, award of the Tribunal below and material papers in the Appeal and upon hearing the arguments of Mr.C.Jawahar Ravindran, Advocate for the Appellant and the Respondents not appeared either in person or by an Advocate, this Court, while allowing the appeal, doth order and decree as follows :- i) that the award passed by the I Additional Sub Judge,-CumMotor Accident Claims Tribunal, Trichirappalli, dated 16.08.2012 made in M.C.O.P.NO.1870 of 2006 be and hereby is set aside ; ii) that, the Appellant herein /Insurance Company be and hereby permitted to withdraw the deposited amount with proportionate accrued interest by filing necessary application before the Tribunal and ;

iii) that, there be no costs in this Civil Miscellaneous Appeal.
