4. Today, when the matter is taken up for hearing, the learned Government Advocate (Crl.Side) would submit that the petitioner's mother is the owner of the property in question. By creating false documents, the third respondent sold the property and hence, the petitioner's mother has filed a complaint, based on which a case has been registered and the same is pending. The third respondent also filed civil suit and also obtained an order of injunction. Thereafter, the petitioner had lodged the present complaint. He would further submit that the complaint given by the petitioner has been enquired into by the second respondent police and has been closed as 'civil dispute'.
5. Considering the fact that the complaint given by the petitioner has been enquired and closed by the respondent police, the prayer as such sought for by the petitioner in this petition cannot be granted at this stage. Accordingly, this Criminal Original Petition is dismissed. However, if the petitioner has any grievance, it is always open to him to initiate appropriate proceedings to redress the same in the manner known to law.
