PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents herein to grant permission for conducting the Mandamus, directing the respondents herein to grant permission for conducting the Manjuvirattu event on 09.04.2022 around 10.00 a.m., in the morning at Kariyenthalpatti, Manappacheri Post, Melur Taluk, Madurai District by including the petitioner's village of Kariyenthalpatti, Manappacheri Post, Melur Taluk, Madurai District in the Madurai District Gazette based on the petitioner's representation dated 25.03.2022.

O R D E R

(Order of the Court was made by S.S.SUNDAR, J.) The writ petition is filed seeking for issuance of a Writ of Mandamus, directing the respondents to grant permission for conducting Manjuvirattu event on 09.04.2022 at Kariyenthalpatti, Manappacheri Post, Melur Taluk, Madurai District by including the petitioner's village of Kariyenthalpatti, Manappacheri Post, Melur Taluk, Madurai District in the Madurai District Gazette based on the petitioner's representation dated 25.03.2022.

2. The learned Special Government Pleader on instructions submitted that permission has been granted to conduct Majuvirattu event and the event also happened pursuant to the permission granted.

3. The learned counsel appearing for the petitioner however states that the petitioner's village is not included in the District Gazette.

4. Even then, the writ petition need not be kept pending as it is liable to be dismissed as infructuous.

5. In the result, the writ petition is dismissed as infructuousNo Costs.

However, liberty is given to the petitioner to approach the third respondent by way of independent representation and when the said representation is submitted, the third respondent may consider the same in the light of the guidelines issued by the Government and after issuing sufficient directions both to the Organizer as well as the participants, if it is possible without affecting the religious sentiments of local residents. If the application is by an individual and he has no means or support to provide adequate security to the viewers and participants, the application shall summarily be rejected. It is made clear that the individuals coming with such applications cannot be encouraged unless the event like Manjuvirattu is organized by the entire village or one or two villages with able leadership of persons, who have sufficient experience and knowledge about the full event and who can provide 2/3

man power and facilities to meet the requirements for conducting such events without any damage or injury to any member of public.
