This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondents to issue free house site pattas in respect of the lands comprised in Survey Nos.211/1B and 211/2, situated at Pillaivayal Group, Sivagangai Taluk, Sivagangai District, to sanitary workers belonging to the Hindu Kuravar Community of Sivagangai Municipality and further directing the respondents to refrain from issuing free house site pattas to persons belonging to other communities, by Page No. 2 of 7

considering the petitioner's representation dated 23.12.2025 and in accordance with G.O.(3D) No.909, Adi Dravidar and Tribal Welfare Department, dated 01.12.1992.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

3. The grievance of the petitioner is that he is the State Secretary of the Sanitary Workers and Adi Dravidar Welfare Sangam. Since the persons belonging to the Hindu Kuravar Community do not own any houses, G.O.(3D) No.909, Adi Dravidar and Tribal Welfare Department, dated 01.12.1992, was issued for providing free house sites to them.

Subsequently, a notification under Section 4 of the Land Acquisition Act was issued stating that the lands specified in the schedule and situated at Paiyoor Pillaivayal Village, Paiyoor Pillaivayal Group, Sivagangai Taluk, Pasumpon Muthuramalinga Thevar District, were required for a public purpose, namely, for providing free house sites to scavengers (sanitary workers) working in the Sivagangai Municipality. 5. The Governor of Tamil Nadu, in exercise of the powers conferred under Section 4(2) of the said Act, delegated such powers to the Tahsildar, Adi Dravidar Welfare Department and other officials of the said Department.

6. Since persons from other places had encroached upon the said lands, the pattas issued in the years 1994 and 1997 in respect of the above lands were cancelled. Thereafter, 64 pattas were issued to eligible beneficiaries in the year 2014.

The petitioner submitted a representation dated 23.12.2025 seeking removal of encroachments and issuance of pattas to 170 eligible persons working as sanitary workers in the Sivagangai Municipality. The petitioner also sought allotment of land for a children's park, school, sanitary facilities, overhead water tank, playground, community hall and Agni Madurai Veeran Temple. However, no action has been taken thereon.

8. The learned Government Advocate appearing for the respondents, on instructions, would submit that the petitioner's Page No. 4 of 7

representation dated 23.12.2025 would be considered and appropriate orders would be passed by the first respondent within a period of sixteen weeks.

Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the first respondent to consider the petitioner's representation dated 23.12.2025 and pass appropriate orders on its merits and in accordance with law within a period of sixteen (16) weeks from the date of receipt of a copy of this order. The representation shall be disposed of after conducting an enquiry. The first respondent is also directed to provide a reasonable opportunity of hearing to the petitioner and any other interested parties who may be affected by such decision, before passing any order. It is needless to state that, if the sanitary workers are found entitled to free house site pattas, the same shall be issued to them in accordance with the Rules and Regulations. No costs.
