ORDER

Invoking the provisions of Article 227 of the Constitution of India, the petitioners have approached this Court with this Civil Revision Petition, seeking a direction to the learned Principal District Munsif, Dindigul to dispose of the suit in O.S.No.199 of 2014 as expeditiously as possible preferably within a time, which may be fixed by this Court.

2. Heard Mr.D.Venkatesh, learned counsel appearing for the petitioners and perused the averments of the grounds of the Civil Revision Petition.

3. It appears that the revision petitioners herein are the defendants 3 and 4. The respondents 1 and 2 herein, who are the plaintiffs in the suit, have filed a suit in O.S.No.199 of 2014 to declare their right of pre-emption to purchase the suit property in case of sale and also for other consequential reliefs. The revision petitioners/defendants 3 and 4 have filed their written statement as early as on 23.03.2015 and the other defendants have colluded with the plaintiffs, purposely, getting adjournments for https://hcservices.ecourts.gov.in/hcservices/

filing counter and therefore, the petitioners being the defendants 3 and 4 have approached this Court by way of this Civil Revision Petition.

4. Having been taken into consideration of the related facts and circumstances, this Court is of view that in the interest of Justice it may be expedient to issue a direction to the trial Court, as sought for by the revision petitioners/defendants 3 and 4.

5. Accordingly, this Civil Revision Petition is allowed. The learned Principal District Munsif, Dindigul is hereby directed to dispose of the suit in O.S.No.199 of 2014, within a period of five months from the date of receipt of a copy of this order, without loss of further time. However, there shall be no order as to costs.
