PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to direct the learned II Additional District and Sessions Judge (PCR), Tirunelveli, to consider the bail application of the petitioner in connection with the FIR in Crime No.21/2023 on the file of the second respondent police on the very same date of the surrender of the petitioner and consequently, to enlarge the petitioner on bail on the very same itself by disposing the petitioner's bail application. ORDER
This Criminal Original Petition has been filed, invoking Section 482 Cr.P.C., seeking orders to direct the learned II Additional District and Sessions Judge (PCR), Tirunelveli, to consider the bail application of the petitioner in connection with the FIR in Crime No.21/2023 on the file of the second respondent police on the very same date of the surrender of the petitioner and consequently, to enlarge the petitioner on bail on the very same itself by disposing the petitioner's bail application. 2/4
2. When the matter is taken up for hearing today, the learned Government Advocate (Criminal Side) appearing for the respondents 1 and 2 would submit that the petitioner is a habitual offender and so many cases have been registered against him.
3. Reading of the list of previous case pending against the petitioner shows that there are 17 previous cases have been registered against the petitioner and most of the case has been filed under 379, 307, 323, 506(ii) of IPC, 21(1) M&N (D&R) Act. Hence, such a person is not entitled for any direction from this Court.
4. In view of the previous cases pending against the petitioner, he is not entitled for any direction. Hence, this Criminal Original Petition stands dismissed.
