ORDER

The petitioner has filed this Writ Petition seeking for a Writ of Mandamus to direct the respondents 1 to 3 to conduct a 2/6

departmental enquiry against the 5th respondent after considering the petitioner's representation to the 3rd respondent dated 27.01.2024.

2. Heard Mr.S.Selvakrishnan, learned counsel for the petitioner and Mr.J.Ashok, learned Additional Government Pleader for the respondents 1 to 4.

3. By consent of both parties, this Writ Petition is taken up for final disposal at the stage of admission itself.

4. The petitioner has filed this Writ Petition seeking a direction against the respondents 1 to 3 to conduct departmental enquiry against the fifth respondent for having given a false complaint against the petitioner and made him to face trial and at the end of which, he got acquittal.

5. If at all the petitioner is aggrieved that the fifth respondent has filed a false case against him, his remedy lies by way of filing a suit for damages within the prescribed time limit and not by way filing any petition of this kind.

6. Accordingly, this Writ Petition is dismissed. No costs.
