O R D E R

This criminal original petition has been filed seeking a direction to the second respondent to complete the investigation in the case in Crime No. 859 of 2023 dated 21.10.2023 and file a final report before the concerned Judicial Magistrate court.

2.When the matter is taken up for hearing, the learned Government Advocate (Crl.Side) submits that the investigation is completed and they found that there is no criminal case made out as against the accused and therefore, they are closing the case.

3.Recording the said submission, this criminal original petition is disposed of with a direction to the respondent to serve the RCS notice along with a copy of the final report to the petitioner within a period of one week, from the date of receipt of a copy of this order. The petitioner is also at liberty to file a protest petition before the concerned Judicial Magistrate, within a period of two weeks thereon. The concerned Judicial Magistrate is also directed to consider the case of the petitioner and take a suitable 2/4

decision as directed by the Hon'ble Supreme Court in the case of Bhagwat Singh vs. Commissioner of Police and another, reported in (1985) 2 SCC 537.
