Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the 1st respondent on the basis of the enquiry report submitted by the 2nd respondent in Pa.Mu.A3/1108/2021, dated 29.10.2021, to cancel the patta issued as patta

no. 875 in the name of the 3rd respondent's husband name Backianathan (Late) during UDR Scheme for the petitioner's family property of S.No.160/5 situated at Pillaiyarkulam Revenue Village, Thiruchuzhi Taluk, Virudhunagar District, and issue patta in the petitioner's name. For Petitioner :

ORDER

The petitioner herein seeks a direction to the first respondent to cancel the patta issued in the name of fourth respondent's husband - Backianathan during UDR scheme in respect of the property of the petitioner situated in S.No.160/5 at Pillaiyarkulam Revenue Village, Thiruchuzhi Taluk, Virudhunagar District.

2. It is the case of the petitioner that the property situated in Survey No.160/5 belongs to him and patta for the said property was wrongly issued in the name of Backianathan, husband of fourth respondent. Hence, he submitted a representation before the second respondent, who conducted an enquiry and submitted a report before the first respondent. Thereafter, the

first respondent initiated an enquiry in his proceedings Na.Ka.Aa2/40773/2022, dated 17.02.2023, on the representation of the petitioner. The same has not been completed. Hence, the petitioner has come before this Court.

3. Government Advocate, appearing for the official respondents, would submit that the proceedings pending on the file of the first respondent will be completed within a time stipulated by this Court.

4. In view of the same, without expressing any opinion on the merits of the matter, the first respondent is directed to complete the proceedings initiated by him in Na.Ka.Aa2/40773/2022, dated 17.02.2023, and pass final orders on its own merits within a period of twelve weeks from the date of receipt of copy of this order, after issuing notice to petitioner, fourth respondent and other legal heirs of Backianathan, if any.

5. Accordingly, the Writ Petition stands disposed of. No costs. 03.07.2025 NCC :
