Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, Certiorarified Mandamus, to call for the records on the file of the 1st respondent in connection with the impugned clarification letter issued by him vide his proceedings in letter Ref.No.SCN/1053089456/25 dated 29.12.2025 and quash the same as illegal and arbitrary and consequently direct the 1st respondent to issue petitioner fresh/renewal passport based on petitioner reply to the show cause notice dated 27.01.2026 within the time limit that may be stipulated by this Court.

ORDER

The present writ petition has been filed seeking to quash the show cause notice issued by the first respondent wherein the petitioner has been called upon to offer his explanation with regard to the adverse police report received by them.

2. The learned Government Advocate(crl.side) appearing for the second respondent brought to notice of the Court that the petitioner has been implicated in a criminal case in Cr.No.330 of 2024 on the file of the the second respondent. So far charge sheet has not been laid.

3. The learned Counsel appearing for the defacto complaint submitted that an order has been passed by this Court for filing of a charge sheet and so far the charge sheet has not been laid.

4. This Court in a judgment reported in 2014 (8) MLJ 61 has held that mere pendency of FIR is not a legal impediment for issuance of the passport. 2/4

5. Considering the above said facts, the first respondent is directed to consider the request of the petitioner for issuance of the passport and pass orders within a period of four weeks from the date of receipt of a copy of this order.
