PRAYER: Civil Revision Petition is filed under Article 227 of Constitution of India, praying to call for the records pertaining to the fair and decreetal order in I.A.No.6 of 2021 in O.S.No.62 of 2011 dated 08.03.2021, on the file of the learned First Additional District Judge, Tiruchirappalli and set aside the same by allowing the present Civil Revision Petition. 1/5

ORDER

This petition has been filed seeking to quash the order in I.A.No.6 of 2021 in O.S.No.62 of 2011 dated 08.03.2021, on the file of the learned First Additional District Judge, Tiruchirappalli.

2.The respondent herein is the plaintiff in O.S.No.62 of 2011 and he has filed a suit for declaration and recovery of possession and the said suit was decreed ex-parte, against which, the petitioners herein have filed a set-aside petition in I.A.No.6 of 2021 in O.S.No.62 of 2011. The said application came to be dismissed, against which, the petitioners have preferred an appeal before this Court in C.M.A.(MD)No.157 of 2020 and the said Civil Miscellaneous Appeal came to be allowed by this Court. Thereafter, the suit was restored and after contest, the said suit came to be decreed in favour of the respondent. Aggrieved over the same, the petitioners preferred an appeal before this Court in A.S.(MD)No.171 of 2022 and the same was dismissed on 31.01.2025. As against the same, the petitioners preferred SLP. Hence, this Civil Revision Petition has become infructuous.

3.Accordingly, this Civil Revision Petition stands dismissed as infructuous. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
