This Criminal Original Petition has been filed seeking a direction to the second respondent police not to harass the petitioner without any legally sustainable complaint.
2.According to the petitioner, there is a dispute pending between the petitioner and the private respondents in respect of the family property and thereby, the private respondents lodged a complaint against the petitioner. Based on the same, the second respondent frequently used to harass the petitioner by issuing summons for appearance and the respondent police insisted the petitioner to settle the matter. Hence this 2/5
petition.
3.The learned Government Advocate (Crl.Side) appearing for the respondent police would submit that based on the complaint given by the defacto complainant, the respondent police have called the petitioner through summons, but the petitioner has not appeared and immediately filed this petition. Since the enquiry is pending, the enquiry will be conducted within a period of one week. He would further submit that the second respondent has not harassed the petitioner and he never insisted the petitioner to settle the matter and he only called the petitioner for enquiry.
4.Considering the limited scope of the prayer sought for in this petition, this Court, without even issuing notice to the private respondent, is inclined to pass order.
5.Recording the submission made by the learned Government Advocate (Crl.Side), the second respondent is directed to complete the enquiry within a period of one week in accordance with law. 3/5
6.With the above direction, this Criminal Original Petition is disposed of.
