Respondent PRAYER: Criminal Original Petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, to direct the Learned Judicial Magistrate, Thiruvaiyaru in P.R.C.No.22/2016 to return the passport of the petitioner bearing Passport No.Z3799060 within a period to be fixed by this Hon'ble court for the aforesaid reasons, it is prayed that this Court may be pleased to direct the Learned Judicial Magistrate, Thiruvaiyaru to return the passport of the petitioner bearing Passport No.Z3799060 deposited in connection with P.R.C.No.22 of 2016.

ORDER
The criminal original petition was disposed of on 06.03.2026. It is listed today under the caption for 'being mentioned' at the instance of the learned counsel for petitioner.
2. At the time of the disposal, in Paragraph 4 of the order, a direction was issued to the learned Judicial Magistrate, Thiruvaiyaru in P.R.C.No.22 of 2016 to return the passport of the petitioner bearing Passport No.Z3799060, as and when he appears before the Court.
3. According to the learned counsel appearing for the petitioner, the passport is in the custody of the learned Principal Sessions Judge, Thanjavur in S.C.No.21 of 2017, from which the petitioner has been acquitted on 20.02.2026. 2/5

In view of the above said facts, Paragraph No.4 of the said order shall be substituted as follows:- "Considering the fact that the petitioner was directed to surrender his passport by way of an order of this Court pending trial in the criminal proceedings, and that the petitioner has since been acquitted, this Court is of the considered opinion that the petitioner may be permitted to get back his passport. Accordingly there shall be a direction to the learned Principal Sessions Judge, Thanjavur in S.C.No.21 of 2017 to return the passport of the petitioner bearing Passport.No.Z3799060 as and when the petitioner appears before the concerned Court.
5. Registry is directed to incorporate the above correction in the order dated 06.03.2026 in Crl.O.P.(MD)No.4977 of 2026 and issue fresh order copy to the respective parties.

6 . The other portions of the order dated 06.03.2026 in Crl.O.P.(MD)No. 4977 of 2026 shall remain unaltered.
