PRAYER: Criminal Original Petition filed under Section 482 of the Criminal Procedure Code, to issue suitable direction, directing the respondents to expedite the investigation in Crime No.480 of 2012, on the file of the Woraiyur Police Station, for recovering the Gold Jewels/ornaments by fixing time limit for filing final report.

O R D E R

This Criminal Original Petition has been filed for a direction to the respondent Police to expedite the investigation in Crime No.480 of 2012.

2.The learned Government Advocate would submit that the respondent Police have filed a final report before the learned Judicial Magistrate No.4, Trichy, on the ground that the case is undetectable. The Referred Charge Sheets have also been issued to the petitioner in this regard.

3.The law is well settled that an investigation which remains undetectable is only a stage under investigation and a final report can never be filed on that ground. 4.Therefore, the respondent Police is directed to continue the investigation effectively and proceed in accordance with law. 5.The Criminal Original Petition is disposed of with the above directions.
