Prayer : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the 2nd and 3rd respondents not to harass the petitioner and his family members under the guise of enquiry based on the petitioner's representation dated 18.02.2023. ORDER

This petition is filed to to direct the 2nd and 3rd respondents not to harass the petitioner and his family members under the guise of enquiry based on the petitioner's representation dated 18.02.2023.

2. When the matter is taken up for hearing, the learned Additional Public Prosecutor appearing for the respondent police submitted that a case in crime No.13 of 2023 was registered against the petitioner. On that purpose only, enquiry was made to the petitioner.

3. In the representation dated 18.02.203, bald allegation has been made against the respondent police as if they foisted false case upon the 2/4

petitioner frequently and even registering the case under NDPS Act.

4. Since FIR has been registered against the petitioner, the petitioner has to face the investigation and the trial process as the case may be and there is no question of harassment here. Accordingly, this Criminal Original Petition is dismissed.
