...Contemnors/ Respondents PRAYER: Contempt Petition filed under Section 11 of Contempt of Courts Act, to punish the contemnors/respondents for willfully disobeying and not complying with the order passed by this Court dated 09.12.2019 in W.P.(MD)No.26097 of 2019. Prayer in WP(MD). 26097/ 2019 :

Writ Petition is filed under Article 226 of the Constitution of India, praying this Court Directing the respondents to pay interest at the rate of 18 percent per annum, for the period of delay from 1.5.2018 to 21.9.2019, in paying the amounts paid towards the terminal and pension benefits of the petitioner namely EPF Employees Contribution, Gratuity, Encashment of Earned/Sick Leaves and Commutated Value of Pension, within a time frame as may be fixed by this Honourable Court.

ORDER

The present Contempt Petition has been filed alleging non compliance of the order dated 09.12.2019, made in W.P.(MD)No.26097 of 2019.

2. The learned counsel appearing for the respondents submitted that the interest amount payable to the petitioner was calculated and paid through ECS to the bank account of the petitioner. https://hcservices.ecourts.gov.in/hcservices/ 1/2

3. However, the learned counsel appearing for the petitioner submitted that the petitioner has no objection insofar as the calculation made by the respondent corporation. Insofar as commutation of pension is concerned, the petitioner is disputing the calculation made by the Tamil Nadu State Transport Corporation Employees Pension Fund Trust, as there is a huge difference.

4. The second respondent viz., the Administrator, Tamil Nadu State Transport Corporation Employees Pension Fund Trust, is directed to furnish the calculation to the petitioner. If the petitioner is aggrieved, it is open to the petitioner to challenge the same.

5. With the above observation, this Contempt Petition is closed.
