PETITION FOR BAIL Under Sec.483 of BNSS PRAYER :- To set order passed in Cr.M.P.No.683 of 2025 in Crime No.5 of 2024 on the file of Learned Principal District and Sessions Judge, Trichy dated 21.02.2025 and consequently pass an order to modify the 1st condition imposed in Cr.M.P.No.1276 of 2024.

ORDER : The Court made the following order :- This petition has been filed to set aside the order passed in Cr.M.P.No.683 of 2025 in Crime No.5 of 2024 on the file of Learned Principal District and Sessions Judge, Trichy dated 21.02.2025 and consequently pass an order to modify the 1st condition imposed in Cr.M.P.No.1276 of 2024.

2.There is no representation on the side of the defacto complainant. 3.The learned counsel appearing for the first petitioner submits that the defacto complainant did not return the car bearing Registration No. TN 10 BA 4587 to the first petitioner.

4. To be noted, on 02.04.2025 itself, this Court dismissed this Criminal Original Petition as infructuous insofar as the second petitioner is concerned, since, he was arrested on 28.03.2025 by executing the Non Bailable Warrant, dated 07.03.2025. 5.In view of the facts and circumstances and in view of the conduct of the 2/4

defacto complainant, this Court is inclined to set aside the order passed in Cr.M.P.No.683 of 2025 in Crime No.5 of 2024 on the file of Learned Principal District and Sessions Judge, Trichy dated 21.02.2025 and accordingly set aside. Further, the condition No.1 imposed vide order dated 23.04.2024 in Cr.M.P.No.1276 of 2024 is deleted. Other conditions imposed in the order dated 23.04.2024 in Cr.M.P.No.1276 of 2024 shall hold good.
