This Writ Petition has been filed seeking a direction to the first respondent to direct the respondents 2 and 3 not to disturb the petitioner's Hotel situated in Thanjavur to Pudukkottai National Highway, based on the petitioner's representation dated 22.01.2025. 2.According to the petitioner, he is running a business in the name of Ayynkaran Bakery and Restaurant nearby Thanjavur - Pudukottai National Highway. Since the road is very busy, he is running the business through out day and night(24*7). Now the third respondent police insisted the petitioner to close the hotel after 11.00 pm. The petitioner is running the hotel without causing disturbance to anybody 2/5
and only for the need of public, he is running the said business. While so, the petitioner sent the representation dated 22.01.2025, requesting the police not to insist him to close the hotel after 11.00 pm, but the same has not been considered. Hence this petition. 3.The learned Additional Public Prosecutor appearing for the respondent police would submit that since the hotel is adjacent to the Highway, without any parking area, the petitioner is running the hotel and thereby, causing traffic disturbance to the vehicles proceeding in the Highway and also by blocking the Highway, the customers used to park their vehicle. Therefore, if the petitioner undertakes not to park the vehicle in the Highway and without any disturbance to the Highway he run his business, the petitioner's representation will be considered and disposed of within a period of one week.
4.Since the petitioner's representation is under consideration by the respondent police, the first respondent is directed to considering the representation, dated 22.01.2025 and dispose of the same, within a period of one week from the date of this order in accordance with law. 3/5
