O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondents, particularly the first respondent, to cancel the patta bearing Patta No.423 issued in the name of the fourth respondent during the UDR Scheme in respect of the petitioner's family properties comprised in Survey Nos.940/1A measuring an extent of 0.61.50 Ares, 944/5 measuring an extent of 0.38.50 Ares and 945/3 measuring an extent of 0.38.00 Ares, situated at Anjukulipatti Village, Dindigul East Taluk, Dindigul District and consequently issue patta in the name of the petitioner's family.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself, dispensing with the notice to the fourth respondent, as no adverse orders are proposed to be passed against him.

3. The grievance of the petitioner is that the subject properties belong to the petitioner's family. However, during the UDR Scheme, the fourth respondent, on the basis of fraudulent documents, obtained patta in his name in respect of the subject properties. Therefore, the petitioner submitted a representation dated 16.02.2026 to the first respondent seeking cancellation of the patta issued in the name of the fourth respondent and issuance of the same in the name of the petitioner's family. However, no order has been passed by the first respondent till date. Hence, the petitioner has been constrained to file the present Writ Petition.

4. The learned Government Advocate appearing for the first to third respondents, on instructions, would submit that the petitioner's representation dated 16.02.2026 would be considered and appropriate orders would be passed by the first respondent within a period of sixteen weeks.

5. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the first respondent to consider the petitioner's representation Page No. 3 of 5

dated 16.02.2026, conduct an enquiry and pass appropriate orders on its merits and in accordance with law within a period of sixteen (16) weeks from the date of receipt of a copy of this order. The first respondent is also directed to provide a reasonable opportunity of hearing to the petitioner, the fourth respondent and any other interested parties who may be affected by such decision, before passing any order. There shall be no order as to costs.
