This petition has been filed challenging the order passed by the Court below dismissing the application filed under Section 311 of Cr.P.C 2.It is seen from the records that the petitioner had already been cross examined P.W.1. The case is of the year 2012 and a recall petition was filed in the year 2016. The Court below has rightly exercised its discretion under Section 311 Cr.P.C and there is no ground to interfere with the order of the Court below.

3.The Court below is directed to dispose of the S.T.C.No.857 of 2012 within a period of one month from the date of receipt of a copy of this order. Accordingly, this criminal original petition is disposed of with the above direction.
