O R D E R

This Writ Petition has been filed seeking the issuance of a Writ of Certiorarified Mandamus to call for the records pertaining to the impugned patta transfer and sub-division order made in T.R.No. 2024/24/15/000460SD dated 28.09.2024 passed by the second respondent, quash the same as illegal and consequently direct the first and second respondents to cancel the patta granted in Patta Nos.2084 and 2085 and the consequential sub-division in respect of the lands comprised in S.No.81/3A, Neer Mangulam-1, Madurai East Taluk, Madurai District, in favour of the third and fourth respondents, and to restore the patta as it stood earlier vide Patta No.465 within the time stipulated by this Court.

2. The learned counsel for the petitioner would submit that the second respondent, without conducting an enquiry and without issuing Page No. 2 of 5

notice to the petitioner and other pattadars, effected the sub-division of the property and transfer of patta in favour of the third respondent vide the impugned order.

3. The learned Additional Government Pleader appearing for the first and second respondents would fairly submit that the records do not disclose that the petitioner was put on notice before effecting the subdivision and transfer of patta.

4. Once a sub-division is effected and patta is transferred, notice shall be issued to the other pattadars and interested parties. Effecting a sub-division or transfer of patta without issuing notice and conducting an enquiry is illegal and violative of the principles of natural justice. Since no notice was served on the petitioner, on that ground alone, the impugned order is set aside and the matter is remitted back to the second respondent to pass a fresh order after issuing notice to the petitioner and other pattadars and interested parties and conducting an enquiry, within a period of sixteen (16) weeks from the date of receipt of a copy of this order.
